Terms of Service

By accessing or using Genlytic at genlytic.app (the "Platform"), you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

These Terms constitute a legally binding agreement between you and Lionel Murbach, operating as Genlytic, Switzerland ("Genlytic", "we", "us", or "our").

Genlytic is a Software-as-a-Service (SaaS) platform for Generative Engine Optimization (GEO). The Service enables users to:

• Track brand and keyword visibility across AI-powered search engines (including ChatGPT, Perplexity, Claude, Gemini, DeepSeek, Grok, and Brave AI)
• Analyze citation frequency, sentiment, and brand positioning in AI-generated responses
• Monitor competitors and generate optimization recommendations
• Create AI-powered content briefs to improve GEO performance
• Access analytics dashboards, reports, and alerts

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice, except where required by urgent security or legal reasons.

You must be at least 18 years old to use Genlytic. By using the Service, you represent that:

• You are at least 18 years of age
• You have the legal capacity to enter into a binding contract
• You are not located in a country subject to a Swiss or EU embargo or on any government restricted-party list
• If registering on behalf of a company, you have the authority to bind that company

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

• Provide accurate and complete registration information
• Keep your password secure and not share it with third parties
• Notify us immediately at hello@genlytic.app upon discovering any unauthorized use of your account
• Not create more than one personal account without our written permission
• Not use another person's account without authorization

We are not liable for any loss or damage arising from unauthorized use of your account where you have failed to maintain the security of your credentials.

You agree not to use the Service to:

• Violate any applicable local, national, or international law or regulation
• Circumvent, disable, or otherwise interfere with security-related features of the Service
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Use automated scripts, bots, or scrapers to access the Service in excess of your plan limits
• Resell, sublicense, or make the Service available to third parties not covered by your subscription without our written consent
• Submit false, misleading, or fraudulent data or brand information
• Attempt to gain unauthorized access to any system, network, or data
• Transmit malware, viruses, or any other malicious code
• Engage in any activity that imposes an unreasonable burden on our infrastructure
• Use the Service to defame, harass, or harm individuals or organizations

Violation of this policy may result in immediate account suspension or termination without refund at our sole discretion.

Paid plans are billed in advance on a monthly or annual basis via Stripe, our third-party payment processor. By providing payment information, you authorize Genlytic to charge your payment method for all fees associated with your chosen plan.

• Pricing: Current plan prices are listed at genlytic.app/pricing. All prices are in USD and exclude applicable taxes.
• Taxes: You are responsible for any applicable taxes (VAT, GST, etc.) arising from your use of the Service. Where required by law, we will add taxes to your invoice.
• Automatic renewal: Subscriptions renew automatically at the end of each billing period unless cancelled prior to renewal.
• Failed payments: If payment fails, we will retry up to 3 times over 7 days. If payment is not received, your account may be downgraded or suspended.
• Plan changes: Upgrades take effect immediately and are prorated. Downgrades take effect at the next billing cycle.

New accounts receive a 14-day free trial with access to trial-tier features. No credit card is required during the trial period. At the end of the trial:

• Your account will be downgraded to a read-only state if no paid plan is activated
• Your data will be retained for 90 days, giving you time to upgrade and retain access
• We will send reminder emails before the trial expires

We reserve the right to modify or terminate free trial offers at any time. Only one free trial per organization is permitted.

You may cancel your subscription at any time via the billing settings in your dashboard or by contacting hello@genlytic.app.

• Effect of cancellation: Your subscription remains active until the end of the current billing period. You will not be charged for subsequent periods.
• No prorated refunds: We do not provide refunds for unused portions of a billing period, unless required by applicable law.
• Annual plans: Annual subscriptions cancelled within 14 days of initial purchase may be eligible for a full refund at our discretion. Cancellations after 14 days receive access for the remainder of the annual period, no refund.
• Data after cancellation: Your data remains accessible for 90 days after cancellation. After 90 days, your data will be permanently deleted in accordance with our retention policy.

If you believe a charge was made in error, contact us within 60 days of the charge at hello@genlytic.app.

Genlytic IP: The Service, including its software, design, algorithms, trademarks, and documentation, is owned by Genlytic and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Service solely for your internal business purposes during the term of your subscription.

Your content:You retain full ownership of the brand data, keywords, competitor lists, and other content you input into the Service ("Your Content"). By using the Service, you grant Genlytic a limited license to process Your Content solely to provide the Service to you.

Feedback: If you submit feedback, suggestions, or ideas about the Service, you grant Genlytic a perpetual, royalty-free license to use such feedback without restriction or compensation.

AI-generated outputs: Reports, briefs, and recommendations generated by the Service are provided for your use. We make no claim of ownership over AI-generated outputs delivered to you.

You own your data. We process it only to deliver the Service as described in our Privacy Policy. We do not:

• Sell your data to third parties
• Use your proprietary brand data to train AI models without your explicit consent
• Share your data with competitors

You are responsible for ensuring that any data you submit to the Service does not violate any third-party rights, privacy laws, or applicable regulations.

Genlytic queries third-party AI engines (ChatGPT, Perplexity, Claude, Gemini, DeepSeek, Grok, Brave AI, and others) and presents their responses for analysis. You acknowledge that:

• AI-generated responses may be inaccurate, incomplete, biased, or outdated
• AI engine outputs can change without notice; historical data may not reflect current behavior
• GEO scores and rankings are estimates based on available data and should not be treated as definitive benchmarks
• Content briefs and optimization recommendations are suggestions, not guaranteed outcomes
• Genlytic is not responsible for decisions you make based on AI-generated outputs

You use AI-generated outputs at your own risk. Always apply professional judgment before acting on recommendations from the Service.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GENLYTIC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free from viruses or harmful components. We do not warrant the accuracy or completeness of any data, reports, or AI-generated outputs.

TO THE MAXIMUM EXTENT PERMITTED BY SWISS LAW, GENLYTIC AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

IN ANY EVENT, GENLYTIC'S TOTAL CUMULATIVE LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU TO GENLYTIC IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) CHF 100.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN TYPES OF LIABILITY. IN SUCH JURISDICTIONS, THE ABOVE LIMITATIONS APPLY TO THE FULLEST EXTENT PERMITTED BY LAW. NOTHING IN THESE TERMS EXCLUDES LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR DEATH OR PERSONAL INJURY CAUSED BY OUR FAULT.

You agree to indemnify, defend, and hold harmless Genlytic and its operators from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from:

• Your use of the Service in violation of these Terms
• Your Content or data you submit to the Service
• Your violation of any applicable law or third-party rights

By you: You may stop using the Service and cancel your subscription at any time via your account settings.

By us: We may suspend or terminate your account immediately and without notice if:

• You breach these Terms or our Acceptable Use Policy
• We are required to do so by law
• Your account has been dormant for more than 24 months on a free/trial tier
• Continued operation poses a risk to the security or integrity of the Service

Upon termination, your right to access the Service ceases immediately. Sections 9, 11, 12, 13, 14, and 16 of these Terms survive termination.

These Terms are governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.

Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Canton of Zurich, Switzerland, subject to any mandatory consumer protection provisions that may apply in your jurisdiction.

We encourage you to contact us at hello@genlytic.app to resolve any dispute informally before initiating formal proceedings.

We may revise these Terms at any time. Material changes will be communicated via email to your registered address or a prominent notice on the platform at least 14 days before the new Terms take effect.

Your continued use of the Service after the effective date of revised Terms constitutes acceptance of the updated Terms. If you do not agree to the new Terms, you must cancel your subscription before the effective date.
